Case Study Consent

In Short: This consent is separate from, and in addition to, the Terms of Service's "Customer Reference" section. It applies only to a Case Study, and only once you give written consent under Section 10.

A "Case Study" means a written, video, or spoken account of how you use the Services, including quotes attributed to you or your team and any results or metrics you approve. If you joined the Pilot Program, a signed copy of this consent is also what unlocks the pilot's larger discount.

Once you consent, we may publish:

• Your company name and logo.
• Your industry and a general company size range.
• Quotes attributed to named people at your company who agreed to be quoted.
• Metrics and results you approve.
• A description of how you use the Services, in the form you approve.

• Our website and blog.
• Sales and marketing materials.
• Social media.
• Press and analyst materials.
• Webinars and events.
• As a reference for a prospective customer who asks, including a reference call if you agree to one.

We send you a draft. You have 10 business days to approve it or request changes. We make the changes you ask for, or remove the material you object to. We publish only after you approve the final draft in writing, by email or e-signature. Silence is not approval. If we want to make a material change after you approve, we send it to you again under this same process.

• Your Confidential Information, as defined in the Terms of Service or a signed agreement between us.
• Personal data about your own customers or end users.
• Details about your security configuration.
• The price you pay, unless you approve including it.
• Anything you tell us, at the time, is off the record.

• You can ask us to correct a factual error at any time.
• You can revoke your consent at any time by emailing us.
• After you revoke, we stop making new uses of the Case Study and remove it from the web properties we control within 30 days.
• Revocation does not reach materials already printed or distributed, or copies republished by someone else outside our control.
• You can limit your consent, for example to specific channels only, or to specific people's quotes only, and we will honor that limit.

You give us a limited, revocable license to use your name and logo as part of the Case Study and on a general customer list. If you give us brand guidelines, we follow them. Using your name or logo does not mean you endorse OptimaFlo beyond what you actually said, and it does not suggest a partnership, joint venture, or affiliation that does not exist.

We do not pay for a Case Study or for quotes. The only benefit tied to a Case Study is the discount described in your Pilot Order, if you are a pilot customer. No individual employee of yours is paid for a quote.

This consent lasts until you revoke it under Section 6. It survives the end of your subscription for materials we already published while it was in effect, subject to your right to revoke and to have removable materials taken down.

You give consent by either of these:

• Replying to our email with: "I consent to the Case Study Consent at optimaflo.io/case-study-consent dated [date]," and naming who may be quoted and any channel limits.
• Signing the e-signature copy we send you.

The e-signature copy we send records:

Customer

• Company name
• Signer name and title
• Email
• Date
• Scope notes, such as which people may be quoted and any channel limits
